1. About These Terms
These Terms of Service govern your use of WithPassage, a digital estate executor service operated by Venu Kondabhathini (ABN: 67 590 405 120) trading as WithPassage.
By creating an account you agree to these terms. If you do not agree, please do not use the service.
2. What WithPassage Does
WithPassage helps Australian families manage the administrative tasks that arise after a death. Specifically we:
- Help you identify and track the deceased person's accounts and subscriptions
- Generate AI-assisted bereavement letters on your behalf
- Provide a checklist of Australian government notifications
- Track progress and send SMS updates
WithPassage is not a law firm and does not provide legal advice.
WithPassage is not a financial adviser and does not provide financial advice.
WithPassage is not an executor of a deceased estate in the legal sense.
For legal estate matters including probate, wills and executor duties you should consult a qualified Australian solicitor.
3. Eligibility
- 18 years of age or older
- Located in Australia
- Authorised by the family to manage the deceased person's estate administration
4. Your Account
You are responsible for:
- Keeping your login credentials secure
- All activity that occurs under your account
- Ensuring the information you provide is accurate
5. Acceptable Use
You agree to use WithPassage only for its intended purpose. You must not:
- Use the service for any fraudulent purpose
- Enter false information about a deceased person
- Use the service to generate correspondence for living persons
- Attempt to access another family's data
6. Pricing and Payment

All prices include GST where applicable. Payments are processed securely by Stripe.
Free trial: You may add up to 3 accounts and generate 1 letter before payment is required. This allows you to experience the service with your actual data before committing.
7. Refund Policy
You are entitled to a full refund if:
- You request the refund within 7 days of purchase, AND
- No letters have been sent on your behalf
Letter send status is automatically verified in our system — no manual proof is required from you.
To request a refund email hello@withpassage.com.au with your account email address. Approved refunds are processed within 5 business days.
After 7 days or after letters have been sent:
No refund is available. However if you are experiencing difficulty we will offer a 3-month access extension as goodwill.
8. AI-Generated Content
Letters generated by WithPassage are created using artificial intelligence. You must:
- Review every letter carefully before approving it
- Not approve a letter you believe is inaccurate
- Take responsibility for letters you approve and send
WithPassage does not guarantee the accuracy of AI-generated letters. We recommend having a trusted person review important correspondence before sending.
9. Data Retention
Your data is managed automatically:
- Active plans: data retained for full plan duration
- After expiry: 90-day archive period with reactivation available
- At 90 days: warning email sent automatically
- At 120 days: all data permanently deleted automatically
You may request immediate deletion at any time by emailing hello@withpassage.com.au.
10. Limitation of Liability
To the maximum extent permitted by Australian law:
- WithPassage is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental or consequential damages
- Our total liability to you shall not exceed the amount you paid for the service
- We are not responsible for how third party organisations respond to letters generated through our service
Nothing in these terms limits your rights under the Australian Consumer Law.
11. Data and Privacy
Your use of WithPassage is also governed by our Privacy Policy available at withpassage.com.au/privacy. By using WithPassage you consent to the data practices described in that policy including the use of AI to process deceased person details for letter generation.
12. Termination
We may suspend or terminate your account if you breach these terms. You may delete your account at any time by emailing hello@withpassage.com.au.
13. Changes to These Terms
We may update these terms from time to time. We will notify you by email of significant changes. Continued use of the service after changes constitutes acceptance of the new terms.
14. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
